Another year has passed and, as we welcome in 2023, a lot of us are certainly feeling unsettled and unsure of the world as everything from politics and the economy, through to the monarchy and our household bills are changing.
One thing that remains the same each year is the temptation to reflect on what has been, and to then look forward to the New Year stretching out in front of us and, perhaps, wanting to make some personal changes ourselves.
For 2023, why not consider making a “New Year New You” with a different kind of resolution and making an appointment with your solicitor to get your affairs in good order. Whilst the rest of the world may feel unsettled, you can have peace of mind that you have put in place the correct personal documents to aid and support you and your family when they will be needed in future.
Have you ever considered what would happen if you were in an accident or developed an illness which meant you could not manage your own finances and needed access to your accounts? If you wish to choose who would do this for you, and to avoid your family having to make costly and lengthy applications to the Courts, you should consider putting a Lasting Power of Attorney in place. This legal document can be prepared and registered ahead of time confirming who you would want to act as your Attorney if you are not able to act yourself.
Whether you have never made a Will before, or whether you have made numerous Wills in the past, making sure you do have a legally valid Will, which is up to date and reflects your wishes, is always important, to ensure that only persons who you would want to benefit from your estate can inherit from you.
Perhaps you have been married or entered a Civil Partnership since you last reviewed your Will and have not realised that your previous Will has been cancelled by that marriage or partnership. Perhaps you have had a child, children or grandchildren, and would like to make sure that they can remember you with a personal gift or generous legacy in your Will when you are gone. Perhaps your business is doing well, and you need to review how best to pass on your business if anything should happen to you with minimal disruption to your Company. Perhaps it has been some time since you understood the potential tax that would be payable on your death, and you wish to minimise any tax liability for those who will inherit from you.
